The following Arbitration Decisions regarding employee grievances have been summarized for informational use only. Please be advised that none of the decisions in any of these cases are precedent setting.

Andriel McGhee v. Nebraska Department of Correctional Services (FOP 88)

The Appellant filed a grievance under Articles 10.1 and 10.2 of the labor contract, when she received a Notice of Discipline terminating her employment for failing to qualify for her firearms certification. Jim R. Titus was selected as Arbitrator and a hearing was held in accordance with the 2025-2027 State of Nebraska and the FOP 88 Labor Contract.

The Arbitrator found that there was just cause to impose discipline due to Appellant’s failure to meet a required competency standard; that the discipline was progressive since the conduct was severe and occurred over three occasions during an annual training, and that the Respondent did not violate the contract. The Arbitrator denied the appeal.
